LiDARic License

The end-user license agreement (EULA) for the LiDARic software. By installing, pulling, running or otherwise using the container image you accept these terms.

By installing, copying, pulling, running or otherwise using this software (the "Software"), you agree to the terms of this License. If you do not agree, do not use the Software.

"Software" means the container image provided by the copyright holder and everything shipped inside it, including its source code, scripts, binaries, configuration files, resources and assets, together with any documentation supplied with it. "Software" does not include your Output as defined in Section 3.

1. Grant of Use

Permission is hereby granted, free of charge, to any person or organization obtaining a copy of the Software, to install, run and use it for any purpose, whether private, educational or commercial.

This permission is non-exclusive, non-transferable and worldwide, and is subject to the restrictions below.

2. Restrictions

The following are NOT permitted without prior written permission from the copyright holder:

  1. Distributing, redistributing, publishing, sublicensing, lending, renting, leasing, selling or otherwise making available the Software, or any copy or substantial portion of it, to any third party — whether modified or unmodified, whether alone or bundled with other software, and whether for a fee or free of charge.
  2. Making the Software available for download or providing it as part of a public repository, package, mirror or archive, including pushing the container image or any image derived from it to a registry that third parties can pull from.
  3. Removing, obscuring or altering any copyright, trademark, license or attribution notice contained in or displayed by the Software.
  4. Modifying, adapting, translating, patching or creating derivative works of the Software itself, or of any part of it. This includes editing, replacing, overwriting or overlaying any file shipped inside the container image, whether in the image itself, in a running container, or by means of a mounted volume, and building a new image from it. This does not restrict the Output you create with the Software (see Section 3).
  5. Reverse engineering, decompiling, disassembling, deobfuscating or otherwise attempting to derive the source code, underlying ideas, algorithms or internal structure of the Software.
  6. Circumventing or disabling any technical protection, license check or usage limitation built into the Software.

The restrictions in (d) and (e) apply only to the extent that applicable mandatory law does not grant you these rights regardless of contract.

3. Output and Results

The restrictions in Section 2 apply to the Software itself, not to what you produce with it.

Any files, data, documents, images, media, reports, code or other material that you create, generate, process or export using the Software ("Output") belong to you or to the respective rights holder. The copyright holder claims no ownership of and no rights in your Output.

Output expressly includes the datasets you create or export with the Software and the classification model code the Software generates for you, together with any templates, snippets or boilerplate the Software emits into that generated code, and any models you train from it.

You are free to use, modify, publish, distribute, license and sell your Output for any purpose, private or commercial, without restriction under this License and without any obligation to pay fees, give attribution or obtain permission.

For clarity: Output is not a derivative work of the Software within the meaning of Section 2(d), even where the Software determined its format or structure.

The line between the two is where the code lives. Code that the Software writes out to you is yours to change and share. Code that ships inside the container image is the Software and may not be modified or redistributed, even if the Software reads, executes or displays it while running.

4. Copies

You may make copies of the Software for backup purposes and for use within your own household or organization. All copies remain subject to this License and may not be distributed to third parties (see Section 2).

5. Ownership

The Software is licensed, not sold. The copyright holder retains all rights, title and interest in and to the Software. No rights are granted other than those expressly stated in this License.

6. No Warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NONINFRINGEMENT. THE COPYRIGHT HOLDER DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, SECURE OR THAT IT WILL MEET YOUR REQUIREMENTS.

YOU USE THE SOFTWARE ENTIRELY AT YOUR OWN RISK. YOU ARE RESPONSIBLE FOR BACKING UP YOUR DATA AND FOR VERIFYING THAT THE SOFTWARE IS SUITABLE FOR YOUR INTENDED USE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COPYRIGHT HOLDER BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY — INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, LOSS OF DATA, LOSS OF PROFITS OR BUSINESS INTERRUPTION — WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OF OR INABILITY TO USE THE SOFTWARE.

Nothing in this License excludes or limits liability that cannot be excluded or limited under applicable mandatory law.

8. Termination

This License terminates automatically and immediately if you breach any of its terms. Upon termination you must cease all use of the Software and delete all copies in your possession or control. Sections 5, 6 and 7 survive termination.

9. Governing Law

This License is governed by the laws of Germany, excluding its conflict of law provisions.
